By 2015, the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization is in force and operational, consistent with national legislation.

The selection of the Aichi Target 16 is based on the commitment of the Government of the Republic of Sudan to fulfill its obligations towards the CBD. The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization was adopted by the Conference of the Parties to the Convention on Biological Diversity at its tenth meeting in Nagoya, Japan, 2010. Hence the target focuses on the Nagoya Protocol and equitable sharing of the benefits of biodiversity arising out of the utilization of genetic resources of biodiversity. The Protocol provides a transparent legal framework for the effective implementation of fair and equitable benefits sharing of genetic resources which urges for capacity-building for the implementation of the Nagoya Protocol.
